Welcome to Phe Calculator, from here on referred to as "the application/website". If you continue to browse and use this application/website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern our relationship with you in relation to this application/website. If you disagree with any part of these terms and conditions, please do not use our application/website.

1. Introduction

These Terms will be applied fully and affect to your use of this Application/Website. By using this Application/Website, you agreed to accept all terms and conditions written in here. You must not use this Application/Website if you disagree with any of these Website Standard Terms and Conditions.

Other than the content you own, under these Terms, PheCalc Co. and/or its licensors own all the intellectual property rights and materials contained in this Application/Website.

You are granted limited license only for purposes of viewing the material contained on this Application/Website.

3. Restrictions

You are specifically restricted from all of the following:

• Publishing any Application/Website material in any other media;
• Selling, sublicensing and/or otherwise commercializing any Application/Website material;
• Publicly performing and/or showing any Application/Website material;
• Using this Application/Website in any way that is or may be damaging to this Application/Website;
• Using this Application/Website in any way that impacts user access to this Application/Website;
• Using this Application/Website contrary to applicable laws and regulations, or in any way may cause harm to the Application/Website, or to any person or business entity;
• Engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Application/Website;
• Using this Application/Website to engage in any advertising or marketing.

Certain areas of this Application/Website are restricted from being access by you and PheCalc Co. may further restrict access by you to any areas of this Application/Website, at any time, in absolute discretion. Any user ID and password you may have for this Application/Website are confidential and you must maintain confidentiality as well.

4. Your Content

In these Website Standard Terms and Conditions, “Your Content” shall mean any audio, video text, images or other material you choose to display on this Application/Website. By displaying Your Content, you grant PheCalc Co. a non-exclusive, worldwide irrevocable, sub licensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.

Your Content must be your own and must not be invading any third-party’s rights. PheCalc Co. reserves the right to remove any of Your Content from this Application/Website at any time without notice.

5. No warranties

This Application/Website is provided “as is,” with all faults, and PheCalc Co. express no representations or warranties, of any kind related to this Application/Website or the materials contained on this Application/Website. Also, nothing contained on this Application/Website shall be interpreted as advising you.

6. Limitation of liability

In no event shall PheCalc Co., nor any of its officers, directors and employees, shall be held liable for anything arising out of or in any way connected with your use of this Application/Website whether such liability is under contract. PheCalc Co., including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Application/Website.

7. Indemnification

You hereby indemnify to the fullest extent PheCalc Co. from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

8. Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

9. Variation of Terms

PheCalc Co. is permitted to revise these Terms at any time as it sees fit, and by using this Application/Website you are expected to review these Terms on a regular basis.

10. Assignment

PheCalc Co. is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

11. Entire Agreement

These Terms constitute the entire agreement between PheCalc Co. and you in relation to your use of this Application/Website, and supersede all prior agreements and understandings.

12. Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the State/Country of Romania, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Romania for the resolution of any disputes.

Privacy Notice

This Privacy Policy describes how PHE Tracker ("we," "us," or "our") collects, uses, and discloses your information when you use our protein calculator mobile application, PHE Tracker App (the "App"). We are committed to protecting your privacy and handling your data with care and transparency.

13. Information We Collect

We collect information that you provide directly to us when you use the App. This includes:

• Account Information: When you create an account, we collect your Name and Email Address, used for account creation, login, and communication.
• Health and Nutrition Data: To provide the core functionality of the protein calculator, you will input your:
  • Daily food intake: Details about the foods you consume, which may include nutritional information, meal times, and quantities.
  • Other relevant data you may input: (e.g. weight, height, etc).
• Usage Data: We may also automatically collect certain information about how you access and use the App. This "Usage Data" may include:
  • Device type, operating system, and unique device identifiers.
  • IP address.
  • Time and date of your use.
  • Features accessed within the App.

14. How We Use Your Data

We use the information we collect for the following purposes:

• To Provide and Maintain the App's Functionality: To process your daily food intake and calculate protein content, and to manage your user account.
• To Personalize Your Experience: To tailor the App's features and recommendations based on your input (e.g., protein targets, dietary preferences).
• To Improve the App: To understand how users interact with the App, identify areas for improvement, and develop new features.
• To Communicate with You: To send you important updates, notifications related to your account or the App, and to respond to your inquiries.

15. How We Store Your Information

Your data collected through the App is stored securely on Google Cloud. Google Cloud employs robust security measures, including encryption at rest and in transit, to protect data. While we use Google Cloud for data storage, we remain the data controller responsible for your personal data.

16. Data Sharing and Third Parties

We do not sell your personal information. We may share your information in the following limited circumstances:

• With Service Providers: We may share your information with trusted third-party service providers who assist us in operating the App, such as Google Cloud for hosting and storage. These service providers are contractually obligated to protect your information and only use it for the purposes for which we disclose it to them.
• For Legal Reasons: We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court order or government agency request).
• In Case of Business Transfer: If we are involved in a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. If we become aware that we have collected Personal Data from a child without verification of parental consent, we take steps to remove that information from our servers.

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Effective Date" at the top. We may also notify you via email or through a prominent notice on the App. You are advised to review this Privacy Policy periodically for any changes.

22. Consent

By continuing, you agree to the processing of your personal and health-related data by PHE App, as described in our Privacy Policy and Terms of Service. Specifically, you give your explicit consent for us to collect, store and process your:

• Name, Email address, Photo for the purpose of maintaining your account and communicating with you.
• Daily food diary, nutritional goals, custom foods and menus for the purpose of calculating and tracking protein and nutrient intake.

You may withdraw your consent and request deletion of your data at any time by going to your Account Settings or contacting us at PHE-Privacy@email.com.
